July 3rd, 2025 – Executive Order 14309 (June 16, 2025) implements the U.S.-UK Economic Prosperity Deal, which includes:
- A tariff-rate quota on UK automobiles
- Preferential tariff treatment for UK auto parts and civil aircraft products
Entry Filing Instructions
Auto Parts (HTSUS 9903.94.32)
Effective June 30, 2025:
- Applies to UK parts for passenger vehicles and light trucks.
- Duty rate: 10% total, including any MFN tariffs.
- Entry summary must:
- Include HTSUS 9903.94.32 first.
- Follow with the applicable Chapter 1–97 HTSUS code.
- ACE will apply the 10% duty rate.
Exemptions & Additional Provisions:
- Exempt from reciprocal tariffs (EO 14257) — use HTSUS 9903.01.33 to claim exemption.
- Non-stacking rule under EO 14289 and Proclamation 10947 applies.
- Chapter 98 claims still valid but do not override 9903.94.32 duties.
- Foreign Trade Zones: Must use “privileged foreign status.”
- No drawback is allowed for these duties.
Civil Aircraft Products (HTSUS 9903.96.01)
Effective June 30, 2025:
- Covers UK-origin civil aircraft, engines, parts, simulators, and components.
- Must meet criteria of General Note 6 of HTSUS.
- Duty rate: As listed in the applicable HTSUS provision (many will be duty-free under “C” designation).
Exemptions:
- Not subject to tariffs from:
- EO 14257 (reciprocal tariffs)
- Proclamation 9704 (Section 232 – aluminum)
- Proclamation 9705 (Section 232 – steel)
Note: Continue to use Special Program Indicator “C” when claiming duty-free treatment under the Civil Aircraft Agreement.
