September 9th, 2025 – On September 4th, 2025, the President signed the Executive Order (EO) “Implementing The United States–Japan Agreement,” establishing new tariff measures under the International Emergency Economic Powers Act. This message provides guidance on the retroactive application of the EO’s tariff provisions.
Key Points:
Establishes a 15% ad valorem duty on nearly all imported products of Japan.
Provides sector-specific treatment for automobiles and parts, aerospace products, generic pharmaceuticals, and non-U.S.-available natural resources.
Subsection 2(d) applies tariffs retroactively to Japanese goods entered or withdrawn for consumption on or after August 7, 2025.
Refunds will be processed under applicable law and CBP’s standard procedures.
The trade community should not file Post Summary Corrections or protests until CBP issues instructions.
CBP will release further guidance via CSMS messages.
