
September 9th, 2025 – This message provides updated guidance on the reciprocal tariff duties established under Executive Order 14257 and modified by the September 5th, 2025 Executive Order. The update clarifies exemptions, reporting requirements, and procedures for implementing trade and security agreements.
Key Points:
Exemptions Updated: Annex II to EO 14257 has been amended to add and remove products exempt from reciprocal tariffs.
Effective Date: Changes apply to goods entered or withdrawn for consumption on or after 12:01 a.m. ET, September 8th, 2025.
HTSUS Classification: Only products properly classified under Annex II headings/subheadings are exempt; importers must use secondary classification 9903.01.32 to claim exemptions under 9903.01.25 or 9903.02.02–9903.02.71.
Entry Corrections: Importers with pre-filed entries must correct filings for added/removed products within 10 days of CBP release.
Trade & Security Agreements: The Secretary of Commerce and USTR may authorize additional exemptions through framework or final agreements.
