September 24th, 2026 – U.S. Customs and Border Protection (CBP) has issued guidance on new restrictions designed to prevent stockpiling of certain polysilicon products ahead of December 4th, 2026.
Under a Temporary Final Rule from the U.S. Department of Commerce:
- Effective September 24th, 2026, Commerce will establish procedures for restricting certain polysilicon imports under Presidential Proclamation 11052.
- Importers exceeding historical volumes may face an import ban. Commerce may identify importers of record (IORs) bringing in polysilicon products at volumes substantially above their historical averages.
- New importers are also subject to limits. New IORs that exceed applicable weekly quantity limits may be restricted.
- Restricted IORs cannot make additional entries of covered polysilicon products for consumption until December 4th, 2026. Once Commerce notifies CBP of the restriction, CBP will prevent further entries until that date.
- Bonded warehouse storage is permitted. Restricted products may be moved to a bonded warehouse but cannot be entered for consumption before December 4th.
- Waivers are available. Affected IORs may apply to the Department of Commerce for a waiver of the prohibition.
